Terms of Service
Version 2026-10-08
In short: what we do, and what we don't
RefTrail exists to help prevent fraud between people who trade with each other, and to make data transparent, so you can judge who you trade with before you trade.
We are not a party to any trade. We do not sell, hold, inspect, pay for or deliver anything, and we do not guarantee any user, item or trade. We are not liable for fraud, loss or damage caused by another user, to the extent the law allows. What you decide to trade, with whom, and how you pay is your own decision and your own risk.
These Terms of Service (“Terms”) govern your use of RefTrail, including the mobile app and the pages served from this domain (together, the “Service”). The Service is operated by [LEGAL ENTITY NAME], registration no. [CVR/REGISTRATION NUMBER], of [REGISTERED ADDRESS] (“RefTrail,” “we,” “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What RefTrail is, and is not
RefTrail helps people trading items with each other, for example through marketplace listings, classifieds or social media, to put a tamper-evident record of an item on their trail and to see signals about the account behind it. RefTrail is not a marketplace, escrow service, payment processor, insurer, arbitrator or background-check provider. We do not buy, sell, hold, inspect or take ownership of any item, and we are not a party to any trade between users. Any purchase, sale or exchange happens entirely between you and the other user, outside the Service, on terms you agree between yourselves.
2. Your account
You must be at least 13 years old to use the Service. If you are under 18, you need the permission of a parent or guardian to use RefTrail and to trade with other users, and they are responsible for what you agree to.
- Signing up with email. You choose a username and a password, and confirm your email address with a code we send to it. The account can't be used until the email is confirmed.
- Signing up with Facebook or Discord. We read your name, and your email where the provider gives it, and you choose a username. Your username is what other users see; it does not have to be your real name. You can add a password later.
- Usernames that look official, such as “admin” or “RefTrail,” or that impersonate someone, are not allowed, and we may change or remove them.
- You are responsible for the information on your account and for everything done with it. Keep your password to yourself, and tell us promptly if you think someone else has used your account.
- One person, one account. Accounts made to fake trades, refs or trust are not allowed.
3. Locked Trail Entries
An item you lock (a “Locked Trail Entry”) is a photo taken through our in-app camera, with checks that make it harder to fake or stage, together with a cryptographic signature and technical details. We store the image, a fingerprint of it (a perceptual hash) and related signals, as described in our Privacy Policy.
A Locked Trail Entry shows that a certain image was captured, at a certain time, by a certain account, through RefTrail. It does not show the condition, authenticity or ownership of the item, that it may legally be sold, or that any trade involving it happened honestly or at all.
4. Levels, XP and “things to consider”
Accounts earn XP and a level (New, Bronze, Silver, Gold, Platinum or Diamond), worked out automatically from things such as linked social accounts, completed trades, refs and disputes on RefTrail. When you look up an item, we may also show “things to consider”: short notes about signals we noticed, such as a new account, few refs, an open dispute or a photo that matches another one.
Levels and notes reflect what we can see on RefTrail only, at the moment they are shown. They are:
- not a guarantee, endorsement, certification or recommendation of anyone by RefTrail;
- not an identity check, background check, credit assessment or promise that someone won't commit fraud;
- not a prediction of how a particular trade will go. A high level can be misleading, and the absence of notes does not mean there is nothing to worry about.
How levels and notes are worked out may change at any time. You are solely responsible for your own judgment and checks before trading with anyone, whatever their level.
5. Refs and disputes
After a trade, you can leave the other user a ref: a reference with stars and a comment. Refs must be honest and about a real trade. We may hide refs that break these Terms.
If a trade went wrong, you can open a dispute and add evidence. The other user can answer, and our team may review the case. We may pause an account while a dispute is looked at, and an upheld dispute lowers an account's XP and may be shown on its items.
Disputes exist to flag problems to other users. They are not arbitration, mediation, insurance or a payment guarantee. RefTrail does not hold, refund or reimburse money exchanged between users, does not promise any outcome or timeline, and may decline to act on a report.
6. What you may not do
You agree not to: stage, falsify or manipulate a Locked Trail Entry or photo; fake trades, refs, disputes or linked accounts; make accounts to farm rewards or trust; use the Service for a trade you know is fraudulent, stolen or illegal; harass or impersonate anyone; get round verification, limits or an account pause; or interfere with the Service or its security.
7. Paid features
Some features may need a paid subscription, billed through Stripe. Subscriptions renew automatically until cancelled; you can cancel at any time, and access continues until the end of the period you paid for. Fees are non-refundable except where the law requires otherwise.
8. Inviting people and partners
You can invite people with your invite code or link. When someone you invited finishes their first deal on RefTrail with someone other than you, you get one month of Premium. Each person can earn this once, also if they make a new account. You can have at most 3 months from invitations waiting to be used at a time, and earn at most 12 a year. The person you invited gets 50% off their first month of Premium when they buy it. We may take rewards back that were obtained through fake accounts, staged deals or other abuse.
Partners chosen by us earn a share of what the people they invite pay for Premium in their first 12 months, instead of free months. The share and how it is paid out are agreed with each partner. Payouts are made outside RefTrail, and partners are responsible for any tax on them.
9. Other services
The Service works with other services, such as Facebook and Discord for signing in and linking accounts, and Stripe for payments. Their own terms and privacy policies apply to your use of them, and we don't control them.
10. Content and intellectual property
RefTrail, its logos, level emblems and app design belong to us. You keep ownership of the photos and text you add, and give us a licence to store, process and show them as needed to run the Service, for example on the page reached by scanning an item's code.
11. No warranties
The Service is provided “as is” and “as available.” To the fullest extent the law allows, we give no warranties, express or implied, including that the Service will be uninterrupted or error-free, or that any level, note, ref, dispute or verification is accurate, complete or a reliable guide to anyone's conduct.
12. Limitation of liability
RefTrail is a service that seeks to prevent fraud and make information transparent. It does not control, and is not responsible for, what users do. To the fullest extent the law allows, RefTrail is not liable for any loss or damage arising from a trade or contact between users, including fraud, scams, theft, counterfeit or misdescribed items, non-payment or non-delivery, whatever that user's level, notes, refs or history on RefTrail, and whether or not we could have noticed it.
We are also not liable for indirect or consequential loss, such as lost profit or lost data. Where liability can't be excluded, our total liability to you for any claim relating to the Service is limited to the greater of what you paid us in the 12 months before the claim, or [amount, e.g. DKK 500].
Nothing in these Terms limits liability that can't be limited under mandatory law, including liability for our own intent or gross negligence, or your statutory rights as a consumer.
13. Indemnity
You agree to cover RefTrail's claims, losses and costs arising from your use of the Service, your content, your trades with other users, or your breach of these Terms.
14. Suspension and ending your account
We may suspend, pause or close an account that breaks these Terms, is part of an unresolved dispute, or that we reasonably believe puts other users at risk. You can stop using the Service and delete your account at any time from the app; see our Privacy Policy for what happens to your data.
15. Changes
We may change the Service and these Terms. When the Terms change in a way that matters, we will ask you to accept the new version in the app. Using the Service after a change means you accept it.
16. Governing law
These Terms are governed by Danish law, without regard to conflict-of-law rules. Disputes between you and RefTrail (not between users) may be brought before the Danish courts. If you are a consumer living in the EU or EEA, you keep the protection of the mandatory consumer law of your country, and the right to bring proceedings there.
